Terms and conditions for using Uber Shop product and services

Earthlets.com is provided to you free of charge for your personal use, subject to these Terms and Conditions. By using Earthlets.com and services you agree to be bound by these Terms and Conditions.

Delivery

  1. All deliveries placed up to 2:30pm on a business day are despatched in time to reach you within your selected delivery timeframe. The delivery charges for the different delivery options are listed on the delivery pages. The cut-off time for a next day delivery option is 2:30pm. 
  2. Before your order is to be dispatched, Uber Shop Ltd might contact you to make sure they are despatching to the correct address or that you are at the delivery address to receive your order. 
  3. Uber Shop Ltd will not be liable for any failed deliveries due to incorrect contact information whether that be the telephone number or in the absence of that the email or incorrect delivery address information. 
  4. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. 
  5. Uber Shop Ltd is not liable in the event of the return of a parcel to our premises due to failure from part of the customer/ recipient to track their consignment. 
  6. All customers are provided with accurate and complete up-to-date tracking details and it is their responsibility to track their parcel and to ensure delivery. 
  7. The courier company informs the customer of a one hour delivery slot on the morning of the scheduled delivery. The courier company also informs customers about any problems with delivery. It is therefore the customers responsibility to arrange for a new delivery and to ensure they receive their parcel. 
  8. Please note that in the event where no action is taken on part of the intended recipient and the customer does not track the parcel using the tracking details provided, the parcel will be returned to our premises at a return cost charged by the courier depending on the original destination of the parcel. 
  9. Should the customer require a re-delivery of the parcel, they will be responsible for the new delivery charges as relevant to the destination and urgency of the re-delivery. 
  10. If we are unable to deliver the order, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss this causes.

Registration

To order from Uber Shop Ltd, you can register with us for an account or continue as a guest. To continue as a guest you are required to enter an email address for order notification and delivery purposes. This is referred to as set up an account or register throughout our website and literature. However, this is not a credit account, payment will be required upon delivery of goods. 
Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the My Account area of the website.


Password and security

When you register to use Uber Shop Ltd you will be asked to create a password. If you use the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update much of the information you provided us with in the Your Account area of the website. 
If Uber Shop Ltd has reason to believe that there is likely to be a breach of security or misuse of the Uber Shop Ltd, we may require you to change your password or we may suspend your account.

Payment

Uber Shop Ltd does not hold any financial information regarding its customers and works with a third-party payment solution whereby all sensitive payment details are securely passed over a  SSL certificate. You must ensure that correct and valid card details are provided. 
We accept Mastercard, Visa, Solo, American Express, Maestro or Switch symbol.

Product purchases

You may submit orders by using our online ordering facility at any time after you have created an account. The facility allows you to review your order and make any corrections before submitting it to us and by submitting the order you confirm that you have made any such corrections. Your submission of an order amounts to an offer to enter a contract to buy the products from us; you cannot then withdraw or cancel your order except as stated below.

No order is accepted from you until we confirm this by electronic communication to you or by delivering the products. A contract for our sale of products to you arises on our acceptance of your order. Once you have placed your order you will receive a confirmation email, however this does not mean that your order has been accepted or processed.

Your order will be accepted once is has been dispatched unless we are unable to accept your order. Where we accept an order, we do all that we can to ensure that your order is fulfilled; products are, however, subject to availability and market conditions and we do not always know if a product is or will be available at the time of accepting an order.

We may not accept an order if

  1. the product ordered is not available in stock
  2. where your order relates to any product being priced incorrectly which has not been intended
  3. we cannot get authorisation of payment for your order or
  4. the terms and conditions of the customer are not met.

If we are unable to deliver an item you have ordered, we will inform you of this and we will remove it from your order so that you are not charged or, if you have paid already, we will refund you the price. We will, however, bear no liability for unavailability of products.

All products offered by us are subject to occasional change in price. Ordering a product from us carries with it the obligation to pay for it unless we receive from you a cancellation of or change to your orders before the deadlines published on the website. We are also happy to inform you of these deadlines by telephone if you wish to call us.

You remain responsible for ensuring that any such change or cancellation is not only transmitted by you, but received by us, in time for the deadline. We reserve the right to deliver and charge in full for any order unless we have received notice of cancellation before the published deadline.

Licence for website access

Uber Shop Ltd grants you a limited licence to access and make personal use of this website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Uber Shop Ltd.

This licence does not include any resale or commercial use of this website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

This website or any portion of this website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Uber Shop Ltd and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilising Uber Shop Ltd or its affiliates names or trademarks without the express written consent of Uber Shop Ltd.

Any unauthorised use terminates the permission or license granted by Uber Shop Ltd. You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the Welcome page of Uber Shop Ltd as long as the link does not portray Uber Shop Ltd, its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any Uber Shop Ltd logo or other proprietary graphic or trademark as part of the link without our express written consent.

Availability of the website

Although Uber Shop Ltd aims to offer you the best service possible, we make no promise that our website services will meet your requirements and we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us (see below for contact details) and we will correct the fault as soon as we reasonably can.

Your access to Uber Shop Ltd may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we reasonably can. In the event that our website is unavailable, our usual order and cancellation deadlines apply; please notify us of changes to your order via email or telephone

Your conduct

You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. You understand that you, and not Uber Shop Ltd nor Uber Shop Ltd, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.

You must not use the website for any of the following: for fraudulent purposes, or in connection with a criminal offence or other unlawful activity to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam" to cause annoyance, inconvenience or needless anxiety

Electronic communications

When you visit Uber Shop Ltd or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
